Terms of Service

1. Acceptance of these terms

By accessing nsfw-ai.app, creating an account, or using any paid plan, you enter a binding agreement with us under these Terms. If you do not agree with any part of them — including the age requirement — do not use the service. We may update these Terms (see Section 15); your continued use after an update counts as acceptance.

2. Eligibility — adults only

This service is available only to individuals who are at least 18 years old, or the age of majority in their jurisdiction if that is higher. By using the service you represent and warrant that you meet this requirement. We verify age where required by law and terminate accounts we suspect belong to minors. The service is not available where it is prohibited by local law.

3. What the service is — and what it is not

nsfw-ai.app provides entertainment: conversations with fictional AI characters, AI image generation, image-to-video and outfit swapping. Please be clear about what that means:

• All characters are fictional AI creations, not real people. You are not chatting with a human being, ever.
• This is not a dating, matchmaking or escort service, and no character can meet, call or contact you outside the app.
• This is not therapy, medical advice, or any kind of professional service. See our Content Disclaimer for details.
• Generated media is produced by machine-learning models. Output can be unexpected, stylized or flawed, and it may vary between generations.

4. Your account

You are responsible for everything that happens under your account. Keep your credentials secret, use one account per person, and tell us immediately at support@nsfw-ai.app if you suspect unauthorized access. You may close your account at any time from account settings; deletion is described in our Privacy Policy.

5. Acceptable use

You may not use the service to:

• Create, request or share content involving anyone under 18 — including fictional, animated or AI-generated depictions. This is an instant, permanent ban, and we report it to the authorities where we are legally obliged to.
• Create or share content depicting real, identifiable people without their explicit consent — including photorealistic deepfakes.
• Upload or generate anything that is illegal in your jurisdiction or ours, including content that promotes real-world violence, non-consensual acts involving real people, or fraud.
• Scrape, crawl, or mass-download the site or its outputs; reverse-engineer or attempt to extract our models; or resell access, credits or generated content at scale.
• Harass, defraud or deceive other users, or impersonate the platform, its staff or any real person.
• Distribute malware, phishing content, or anything that damages the service or its users.

Violations may result in content removal, credit forfeiture, suspension or permanent termination, without refund, at our discretion.

6. AI-generated content — your responsibility

You control the prompts you write and the content you generate. You are solely responsible for ensuring your use of generated images, videos and conversations is lawful where you live and where you share it. We provide the tools; we do not pre-approve your output beyond automated safety scanning. If you share generated media that depicts real people or is used to harm someone, the responsibility — and legal exposure — is yours.

7. Your content and your rights

You retain ownership of the prompts you write and the images and videos you generate, to the extent such ownership is possible under applicable law. By using the service you grant us a limited license to store, process and display that content in order to run the service — and nothing more. We do not claim ownership of your characters or media, and we do not use your private content for marketing or model training. You may delete your content at any time, subject to the retention periods in our Privacy Policy.

8. Our intellectual property

The platform itself — software, design, brand, pre-made characters and their likenesses, marketing materials and the underlying models and their outputs policy — belongs to us or our licensors. You may not copy the platform, clone the characters for use outside the service, or use our brand in a way that suggests endorsement. Using our name to promote competing services or third-party apps is prohibited.

9. Subscriptions, payments and billing

Premium is available with monthly, quarterly or yearly billing. Prices are in USD: the monthly plan charges $9.99 for the first month, then renews at $13.99 per month. The quarterly plan charges $26.97 every three months ($8.99 per month). The yearly plan charges $47.88 every year ($3.99 per month). Subscriptions renew automatically until you cancel. Quarterly and yearly plans renew at the same price and term. Local taxes may apply; your total and renewal terms are shown at checkout. Any future price increase will be communicated before renewal at the increased price. Payments are processed by third-party providers; we never see your full card details.

All billing periods include unlimited text chat and 100 tokens each month. Tokens arrive on your subscription anniversary each month, including on quarterly and yearly plans. Images, videos, voice messages and custom characters use tokens. Additional token packs are purchased separately.

10. Cancellation and refunds

Cancel renewal in Settings / Unsubscribe at any time. Premium remains active until the paid period ends, with no charge for the next period. Cancellation does not automatically refund a payment. Any remaining tokens expire when your paid access ends and cannot be carried over or refunded.

Request a refund separately by emailing support@candymail.ai within 24 hours of payment. Subscription refunds require a card purchase and no more than 20 tokens used. Token-pack refunds require a card purchase and no tokens used. User-side technical issues are excluded. Purchases made in error are not guaranteed a refund. A refund ends Premium access and removes remaining tokens immediately.

EU and UK residents have 14 days from the purchase confirmation email to withdraw from an initial purchase. This right does not apply to renewals. A deduction may cover services already used. Notify support of your decision before the deadline. Refunds use the original payment method within 14 days of notice, unless otherwise agreed. Any additional mandatory consumer rights apply.

11. Disclaimer of warranties

The service is provided "as is" and "as available". We work hard to keep it online, fast and safe, but we make no guarantees that it will be uninterrupted, error-free, or that generated content will meet your expectations. AI output can be inconsistent, repetitive or stylistically imperfect — that is the nature of generative models. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, our total liability for anything arising out of the service — whether contract, tort or otherwise — is limited to the amount you paid us in the three months before the claim. We are never liable for indirect, incidental, special or consequential damages, including emotional distress related to your use of AI companions. Nothing in this section limits liability that cannot be limited by law, such as liability for gross negligence or fraud.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, or content you generated or shared that violates the law or a third party's rights.

14. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that breach these Terms, with or without notice depending on severity. On termination, your right to use the service ends immediately; content may be deleted per our Privacy Policy. The sections that naturally survive termination — liability, indemnification, IP — continue to apply.

15. Changes to these terms

We may update these Terms as the product or the law evolves. Material changes are announced by email and in-app notice at least 14 days before they take effect. Non-material changes take effect on publication. You may cancel renewal if a change affects your paid plan adversely. Refund eligibility follows Section 10, subject to any mandatory consumer rights.

16. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where the operator of nsfw-ai.app is established, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your country of residence says otherwise. Before any formal action, both sides agree to try to resolve the dispute through good-faith negotiation — email support@nsfw-ai.app and we will respond within 14 days.
